These Terms of Service ("Terms") govern your use of Avandra.
Avandra is operated by Kenneth Killeen, trading as Avandra ("Avandra", "we", "us" or "our").
By creating an account or using Avandra, you agree to these Terms.
Avandra is a travel planning and management service designed to help users plan, prepare for, explore and record trips.
Features may include trip and tour planning, destinations, maps, campsites, activities, challenges, vehicle information, maintenance, inventories, checklists, expenses, fuel records, weather information, reviews, photographs and other travel-related tools.
Avandra is under active development. Features may be added, changed or removed as the service develops.
Eligibility and family accounts
Avandra is intended to be used by families.
To create an Avandra account as a primary account holder, you must be at least 18 years old.
A primary account holder may add a secondary ("family member") account to their family group for another person aged 15 or over.
The primary account holder is responsible for the appropriate use of Avandra by any secondary account in their family group, and for the supervision and safety of any children or other family members involved in trips, challenges or other activities arranged through Avandra.
Avandra does not verify the age of secondary account holders. Avandra takes no responsibility for children's actions taken as a result of family activity — that responsibility rests with the adult primary account holder.
Account responsibilities
Some Avandra features require an account.
You are responsible for:
You may not create an account using another person's identity or deliberately provide false or misleading information.
Avandra may allow you to create or access your account using Google Sign-In.
Your use of Google services remains subject to Google's own terms and policies.
Avandra does not receive or store your Google password.
Information received from Google in connection with authentication is handled in accordance with our Privacy Policy.
Disconnecting Avandra from your Google Account does not necessarily delete your Avandra account. You must use Avandra's account deletion process if you wish to delete your Avandra account and associated data.
You may use Avandra for lawful personal use in accordance with these Terms.
You must not:
We may restrict or suspend access where reasonably necessary to protect Avandra, its users or third parties, or where these Terms have been materially breached.
You may add information and content to Avandra, including trips, reviews, photographs, notes, vehicle information and other material ("User Content").
You retain ownership of your User Content.
You give Avandra a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce and display your User Content only to the extent reasonably necessary to operate, maintain and provide Avandra to you.
You are responsible for ensuring that you have the right to upload and use any content you add to Avandra.
You should not upload material that is unlawful, defamatory, abusive, infringes intellectual property rights or violates another person's privacy.
Avandra and its original software, design, branding, graphics, databases, text and other content are owned by Avandra or used under licence, except for User Content and material supplied by third parties.
Using Avandra does not transfer ownership of Avandra's intellectual property to you.
You may not reproduce, redistribute, sell or commercially exploit Avandra or substantial parts of its content without permission, except where permitted by law.
Avandra may provide information about campsites, routes, trails, destinations, attractions, activities, businesses and other places.
Some of this information may come from third-party providers, public datasets, community contributions or other external sources.
Although we aim to provide useful and accurate information, information can become outdated, incomplete or incorrect.
You should verify important information directly where necessary, particularly:
The inclusion of a campsite, location, route, business or activity within Avandra does not constitute a guarantee or endorsement.
Avandra may provide tools relating to routes, driving distances, journey times, vehicle dimensions, payload, maintenance, fuel consumption or other vehicle information.
These tools are intended to assist with planning. They are not a substitute for your own judgement, official road information, vehicle documentation or professional advice.
You remain responsible for ensuring that:
Do not rely on Avandra as an emergency, safety-critical or turn-by-turn navigation system unless a feature is expressly described as providing that functionality.
Weather forecasts, warnings and environmental information displayed in Avandra may be supplied by third-party services.
Weather conditions can change rapidly and forecasts may be inaccurate.
For safety-critical decisions, you should check appropriate official weather, emergency or local information.
Avandra may include challenges, suggested activities, destinations, landmarks, walks, routes or other experiences for users to discover or complete.
Participation in any challenge or activity is entirely voluntary and undertaken at your own risk.
Avandra does not assess or guarantee the safety, accessibility, legality or suitability of a challenge, activity or location for you, your vehicle, your passengers or your circumstances.
Conditions may change and locations may involve hazards including traffic, difficult terrain, weather, water, heights, private property, restricted access or other risks.
You are responsible for assessing the risks before taking part, following local laws and restrictions, obtaining any necessary permissions, using appropriate equipment and deciding whether an activity is safe for you.
Where a challenge or activity is undertaken by a secondary ("family member") account or a child as part of family activity, responsibility for assessing suitability, obtaining consent and supervising participation rests with the primary account holder, not with Avandra.
Information provided by Avandra is intended for general travel and discovery purposes and should not be treated as professional safety, medical, navigation or emergency advice.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
Avandra may allow users to submit reviews, ratings, photographs, recommendations or other information.
These represent the views or experiences of individual users and not necessarily those of Avandra.
We may moderate or remove content where reasonably necessary, including content that breaches these Terms, infringes another person's rights, is fraudulent, abusive or clearly irrelevant.
Avandra may display locations, overnight stops, parking places, campsites, points of interest or other places submitted, recommended or reviewed by members of the Avandra community.
Community Locations have not necessarily been inspected, verified or approved by Avandra.
The presence of a location within Avandra does not mean that:
You are responsible for checking signage, local regulations, land ownership, access restrictions, vehicle restrictions and current conditions before travelling to or using a Community Location.
Use of a Community Location is at your own risk. Avandra is not responsible for loss, damage, fines, penalties, towing, injury or other consequences arising solely from your decision to visit or use a Community Location, except to the extent that liability cannot lawfully be excluded.
Avandra encourages all users to follow Leave No Trace principles and to travel responsibly and respectfully. When visiting campsites, Community Locations, challenges, trails or other places featured in Avandra, you should minimise your impact, dispose of waste appropriately, respect wildlife and other visitors, avoid damaging vegetation or property, use established access routes where possible, and leave places as you found them.
The inclusion of a location in Avandra does not create a right of access or permission to camp, park or enter private land. Users are responsible for respecting landowners, local communities, signage, restrictions and applicable laws at all times.
Avandra may use or integrate services operated by other organisations, including authentication, mapping, weather, payment, analytics and other information providers.
Third-party services may have their own terms and privacy policies.
We are not responsible for third-party websites or services that are outside our control.
We aim to keep Avandra available and reliable, but we cannot guarantee uninterrupted or error-free operation.
The service may occasionally be unavailable because of:
We may modify Avandra as the service develops.
Where a change materially affects a paid service or your legal rights, we will provide any notice required by applicable law.
Some Avandra features may be identified as beta, experimental, preview or otherwise under development.
Such features may change significantly, contain errors or be withdrawn.
You should not rely on beta or experimental functionality as the sole repository for information that is important to you.
Avandra may introduce subscriptions or other paid features.
Where payment is required, the price, billing period, renewal arrangements and applicable cancellation conditions will be presented before you purchase the service.
Additional terms may apply to particular paid services.
Nothing in these Terms affects any mandatory cancellation, refund or other consumer rights available to you under Irish or EU law.
Our collection and use of personal information is explained in the Avandra Privacy Policy.
You are responsible for maintaining your own copies of information that you consider particularly important.
Where account deletion is available, deleting your account may permanently remove information associated with that account, subject to our legal obligations and the retention arrangements described in our Privacy Policy.
You may stop using Avandra at any time.
You may request deletion of your account through the account deletion functionality provided by Avandra or by contacting us.
We may suspend or terminate an account where reasonably necessary because:
Where appropriate and reasonably possible, we will provide notice before terminating an account.
Avandra is intended to assist with travel planning and organisation. It does not replace your own judgement or responsibility when travelling, driving, camping or undertaking activities.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms affects your statutory rights as a consumer.
To the extent permitted by law, Avandra is not responsible for loss arising solely from:
We do not attempt through these Terms to exclude responsibility that cannot legally be excluded under Irish or EU consumer law.
We may update these Terms where reasonably necessary, including because of:
The current version will always show the date on which it was last updated.
If a change materially affects your rights or obligations, we will provide appropriate notice before it takes effect where required.
These Terms are governed by the laws of Ireland.
If you are a consumer resident elsewhere in the European Union or another jurisdiction with mandatory consumer protections, you retain any rights that applicable law gives you and that cannot lawfully be excluded by these Terms.
Nothing in these Terms prevents you from bringing a claim in a court where applicable consumer law gives you the right to do so.
